Medical Negligence claims in Yorkshire cost taxpayers £161 million.

The Yorkshire post today publicised the fact that soaring litigation costs are hitting the NHS card. This followed a news bulletin from the NHS Litigation Authority stating that litigation costs were spiralling out of control.

Whilst this fact on its own cannot be disputed, it hides a more serious issue regarding the state of health care within the huge edifice that is the NHS. The simple truth is that the NHS is failing thousands of patients in delivering a sub-standard level of care.

Every week there are stories within the national press about the filthy conditions that many patients find themselves in whilst hospitalized. Superbug infections such as MRSA and CDifficile are rife and there are many thousands of instances of outright negligence on the part of medical doctors.

Our legal service deals with hundreds of medical negligence enquiries every month. From patients who come to us for advice following accidents or problems that occur whilst receiving treatment. Many cases revolve around poor advice from consultants and GPs’.

We believe that the surge in compensation claims results from two fundamental arguments that cannot be denied.

TomTom XL 340S 4.3-Inch Portable GPS Navigator Bundle with Case EASY,ACCURATE,PERFECT – P. Murphy – Plymouth,Ma.
This is our first GPS and we loved it. We have borrowed and used a Garmin,but this TOM TOM blows it out of the water!. We started using it around town for small trips to get used to it and found it was very accurate. The big test was taking in to S.C. and it was “awesome baby”. We particularly liked the ” two mile” warning and what lane to get into after you make a turn. It really was handy when we were in S.C. and we wanted to visit different sites and restaurants. Again it was “perfect” we couldn’t be happier.
I bought this after reviewing many different units. It seems all GPS units have one or two quirks about them, but after researching I decided to go with the TomTom 340S. The biggest complaint was about downloading a new map from the TomTom website (the file was too large for the unit), when I plugged the unit into my CPU and went to the website I verified the size of the file and the size of the hard drive on the unit, downloaded the file, and had a new map installed with no problems. It did take quite some time to download and install the new map – well over an hour.

As far as the unit’s capabilities and ease of use, I would rate them both as good to great. The only problem I ever have is the screen is not being bright enough during times when the sun is especially bright. But, I never really have an issue with directions because it is plenty loud enough and gives clear instructions that include the street or exit name. I haven’t had any routes that seemed out of the way or wrong to me. A few times I came to a street that was under construction, so the road was blocked, a great feature is that you can correct the map – so I blocked the street on the unit and now it avoids that route. You can also update speed limits so you have them accurate when traveling.

I have used this unit throughout Columbus, Ohio. I also used it briefly in Fayetteville, North Carolina and Milwaukee, Wisconsin. In all places the maps were accurate, as well as on the freeways between all three of these cities.

If you are considering buying a GPS I would recommend this one. For around a 0 I don’t think any other one on the market can compete.

Here’s an interesting case I handled recently: It involved a young man who put his arm through a window. He was taken to the emergency room where he was bleeding profusely from cutting an artery. He had a “pumper,” with blood spurting and pulsating out like a garden hose. While in the emergency room a doctor tried to stop the bleeding by applying pressure to the wound. This worked, but the young man needed a blood transfusion since he lost a lot of blood during the five minutes from accident site to the hospital.

After the bleeding was initially controlled, another doctor came to stitch the wound. The doctor, while throwing stitches, never realized that he put a stitch around the ulnar nerve! This is a big “no-no.” Stitches are meant to tie off bleeding vessels like veins and arteries. They are not meant to tie off good, healthy nerves.

Importantly, while the patient was being stitched up, he yelled out that his arm felt as if it had been ‘zapped’, similar to hitting your funny bone. The doctor simply said “Don’t worry about it, you’ll be fine.” Well, a day or two later, the young man, thinking that it’s ok to have unusual sensations in his had following this accident did not think much of the ongoing discomfort he was having in his hand. By day three, he started to think something was really wrong. His fourth and fifth finger were getting numb and were also painful.

The patient returned to the hospital, where it took some coercion to get the clinic residents to evaluate his hand. Despite the patient’s complaints, he was sent home, and told it it normal to have this pain following such an accident. Two days later, the numbness and inability to move the fourth and fifth fingers brought the patient back to the hospital clinic. Again, nobody recognized that the young man’s ulnar nerve was dying off before their eyes.

This young man made a wise decision to get an opinion from an experienced hand surgeon in New York City. Immediately upon being examined, the hand surgeon advised the patient that he had significant damage to his ulnar nerve; precisely the nerve that controls the fourth and fifth fingers. Exploratory surgery revealed the patient’s worst fears:

“A suture used to tie off bleeding vessels had somehow been used instead to tie off your ulnar nerve,” was what the hand surgeon advised him. “As a result, your ulnar nerve was deprived of oxygen and blood flow, causing the nerve to die.” This young man was told that he’d need another surgery to try and transplant another nerve from a different part of his body into his arm to see if that would help. He was told that nerves can regenerate, if lucky, at a rate of one inch per month. In other words, a very slow process.

The second surgery went well, and he did not need a nerve transplant. Instead, the existing nerve was cleaned up, and stretched as gingerly as possible to get close enough to attempt to reattach the two damaged ends of the nerve. Eighteen months later, this patient still had loss of sensation and decrease in function in his hand.

The moral of this tragic story is that this injury was totally preventable. Had the emergency room doctor been careful in placing those stitches, and had the clinic residents recognized the signs of nerve damage two days after the accident, this event leading to permanent nerve damage never would have happened.

End Result:

Through extensive investigation and many depositions, I was able to finally learn that one or more doctors had sutured the wound closed. What made this case so fascinating is that the doctor or doctors who stitched this patient up, never wrote a note in the hospital chart- It’s almost as if they knew what they did was inappropriate and did not want to acknowledge it.

The case settled favorably during jury selection.

The first one I ordered had some problems. It had a cosmetic blem in the weave of fabric on one side and the zipper didn’t want to round one of the corners. I told the seller about it and they send another one right out. I asked that they actually send me a different color and they didn’t manage that, though they said they would. I’d have been nicer if they’ve either given me the other color I asked for or just said no, but they did ship my replacement out very quickly – I got to wait until the new one arrived before sending back the old one I think and I appreciate that show of trust. Medical Negligence is professional negligence by act or omission by a health care provider e.g Doctor, Nurse etc.. in which care provided deviates from accepted standards of practice in the medical community and causes injury to the patient.

A Special Health Authority ( NHS Litigation Authority) is responsible for handling both clinical and non-clinical negligence cases on the behalf of the NHS in England.

The NHSLA has a number of different schemes to handle Medical Negligence Claims.

The Clinical Negligence Scheme for Trust (CNST). Is a voluntary risk-polling scheme for clinical negligence claims arising out of incidents occurring after 1st April 1995.

The Existing Liabilities Scheme. This covers clinical negligence claims arising out of incidents which occurred before 1st April 1995.

The Ex-RHAs. Covers any clinical liabilities incurred by the Regional Health Authorities before their abolition in April 1996 with the NHSLA itself acting as defendant.

The Liabilities of Third Parties Scheme. Covers non-clinical “third-party” liabilities.

The Property Expenses Scheme. Covers “first Party” losses by NHS bodies.

In 2007/08, the NHSLA made payments totaling £661.04 million for all 5 schemes. They received 5,470 claims (including potential claims) under its clinical negligence schemes and 3,380 claims (including potential claims) in respect of its non-clinical negligence schemes.

CNST claims are now settle in an average of 1.50 years. This is counting the date of notification to the date when compensation is agreed or the claim is abandoned.

From all 5 schemes between the 01/04/1997 and 31/03/2008 41% cases are abandoned by the claimant, 42% is settled out of court, 4% is settled in court and 13% are outstanding.
